The Pocket Protector, LLC ("TPP," "we," "us," or "our"), a subsidiary of NaviGap LLC, is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit thepocketprotector.com or any subdomain, application, or service operated by TPP.

1. INFORMATION WE COLLECT

Information You Provide Directly: Name, email address, phone number, date of birth, ZIP code, county, state of residence, Medicare beneficiary information, prescription medications, doctor preferences, income and asset information, employer information, and any other information you voluntarily provide.

Information Collected Automatically: IP address, browser type and version, operating system, referring URL, pages visited, time spent on pages, click patterns, device identifiers, and general geographic location.

Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to improve the Site, analyze usage, and deliver relevant content. You can manage cookie preferences through your browser settings.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to: (a) provide, maintain, and improve the Site; (b) respond to your inquiries and provide Medicare guidance; (c) match you with a licensed Medicare advisor; (d) process enrollments; (e) send administrative communications; (f) analyze usage patterns; (g) comply with legal obligations; and (h) protect against fraud and abuse.

Usage Analytics and Session Replay: We use analytics service providers (including PostHog, operating under a HIPAA business associate agreement) to understand how our website and mobile app are used — for example, which screens people visit and where they get stuck. This may include replaying usage sessions in which the information you type and any personal or health-related content are masked before the recording is created. These recordings never contain your health, insurance, coverage, or Medicare information.

We do NOT sell your personal information. We do not sell, rent, lease, or trade your personal data to third-party data brokers, lead aggregators, or marketing companies. Period.

3. HOW WE SHARE YOUR INFORMATION

(a) Insurance Carriers: When you choose to enroll in a plan through TPP, we share the information necessary to process your enrollment.

(b) Service Providers: Trusted third-party service providers who perform services on our behalf, subject to contractual data protection obligations.

(c) Legal Requirements: When required by law, regulation, legal process, or governmental request.

(d) Business Transfers: In connection with any merger, acquisition, or sale of assets.

We will never share your information with competing insurance agencies or brokers.

4. ADVERTISING MEASUREMENT (MOBILE APP)

When you install or use our mobile app, we share limited technical information with Meta Platforms, Inc. to measure the effectiveness of our advertising — specifically, device advertising identifiers (only where you have permitted tracking), anonymous app events such as app installs and app opens, and related device information such as IP address. We never share your health, insurance, coverage, or Medicare information with advertising partners.

On iOS, you can decline this at the App Tracking Transparency prompt or in Settings → Privacy & Security → Tracking. On Android, you can reset or delete your advertising ID in Settings → Google → Ads. Where state law treats this as "sharing" of personal information for cross-context behavioral advertising, you may opt out as described above or by contacting us at privacy@thepocketprotector.com.

5. DATA SECURITY

We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption (TLS/SSL), access controls, secure data storage, and employee training.

6. YOUR RIGHTS AND CHOICES

Access and Correction: Contact privacy@thepocketprotector.com to request access to or correction of your personal information.

Deletion: You may request deletion of your personal information, subject to legal compliance exceptions.

Opt-Out of Communications: Click "unsubscribe" in any email or contact us directly.

7. HIPAA AND PROTECTED HEALTH INFORMATION

We treat all health-related information you share with us with the same level of care and confidentiality as protected health information. We do not use health information for unrelated marketing purposes.

8. MEDICARE-SPECIFIC PRIVACY OBLIGATIONS

As a licensed Medicare agency, we comply with all applicable provisions of 42 CFR Parts 422 and 423 relating to the protection of beneficiary information.

9. CHILDREN'S PRIVACY

The Site is not directed to individuals under the age of 18 and we do not knowingly collect personal information from children.

10. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

California residents have additional rights including the right to know, the right to delete, the right to opt out of the sale of personal information (we do not sell personal information), and the right to opt out of the "sharing" of personal information for cross-context behavioral advertising. The advertising measurement described in Section 4 may constitute "sharing" under the CCPA/CPRA; you may opt out using the device settings described there or by contacting privacy@thepocketprotector.com.

11. STATE-SPECIFIC PRIVACY RIGHTS

Residents of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have additional rights. Contact privacy@thepocketprotector.com.

12. DATA RETENTION

We retain personal information as long as necessary to provide services and comply with legal obligations. Enrollment-related records are retained for a minimum of 10 years as required by CMS. Website usage data is typically retained for 2 years.

13. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Material changes will be posted with an updated "Last updated" date. Continued use of the Site constitutes acceptance.
